By Nathan Baca NewsChannel 3 Eisenhower Medical Center is responds to a jury s decision that the hospital unlawfully over-prescribed painkilling drugs. A lawsuit alleged that patients were physically and mentally harmed by their doctors. The jury also decided that the employee who blew the whistle on this was wrongfully fired. The hospital s pharmacy was the focus of the lawsuit. A Los Angeles Times newspaper article outlined allegations of unlawful practices inside the pharmacy. The hospital was reportedly making such a profit off of a painkilling drug called fentanyl that it prescribed excessive amounts to patients. A jury decided in 2006 that pharmacist Terry Blasingame faced retaliation for complaining about unlawful practices dealing with how the doctors handled narcotic drugs. "I felt that Eisenhower didn t document a lot of things," says one former juror who heard the case. "It seemed as if they were ignoring a lot of the allegations and not doing anything about it." Eisenhower Medical Center responded not giving an interview but reading from a prepared statement. "Several of these allegations are false and misleading. More importantly, Eisenhower had taken actions to address the allegations at the time and is currently reviewing all of the issues detailed in the article." The jury also decided the hospital was guilty of oppression malice or despicable conduct. The hospital was told to pay Blasingame more than a million dollars. The hospital later settled for an undisclosed amount. The hospital goes on to say in the statement that the California State Board of Pharmacy reviewed the hospital s pharmacy s conduct regarding these allegations and found no issue with the pharmacy or the prescribing physician s conduct. But page after page of this verdict has a jury deciding that Eisenhower Medical center was prescribing powerful painkillers to the point of causing serious harm to its patients. Terry Blasingame s attorney said that he and his client cannot talk about the case possibly because of the settlement. Eisenhower managers tell us that they do not agree with the jury s decision.
