Last month I mentioned the mismatch between the content of the first episode of e.tv's The Biggest Loser reality show and the adverts which were screened in the many commercial breaks.
While the contestants were subjected to tortuous exercise regimens and apparently had their diets strictly controlled, the adverts promoted the quick fix, pop-a-pill route.
And, as I pointed out at the time, several of the ads were in contravention of the health department's requirements for labelling and advertising of slimming products - they may not imply that the product interferes with the normal physiology of the body, as medicines do.
Well, by week two, those "offending" adverts had disappeared, although e.tv insisted the station hadn't been instructed to amend their advert schedule.
Then, earlier this month, one of them was back - Verimark's MyWeigh, but heavily edited to remove the offending claims.
Most notably, gone is the claim: "accelerates metabolism, controls appetite and burns fat, giving you a leaner, more beautiful body".
The skinny GI Lean girl is still wiggling her hips in every ad break, because the product is the show's main sponsor. Many viewers no doubt assume that the contestants are using the product in a bid to shed the kilos as fast as possible, especially as there has been curiously virtually no coverage of what they are actually eating in that house.
But, in reality, none of them used the GI Lean "weight loss programme" at all, e.tv has confirmed.
Interestingly, last week the Advertising Standards Authority's Directorate considered a consumer complaint against two of GI Lean's adverts flighted on The Biggest Loser's first episode on January 7. The adverts featured the testimonials of two former fatties who had shed 61kg and 56kg respectively, having used GI Lean products.
A Mr J Gardener complained that the compulsory disclaimer: "only effective as part of a low GI kilojoule-restricted eating plan", appeared on screen in tiny letters and was not easy to read.
GI Lean responded by saying that it would amend those adverts to show that message in larger print.
As always, the ASA accepted this undertaking "on condition that the advertising in its current format is not used again". Case closed.
Well, I watched the show again this Monday night - four days after the ruling - and the two adverts in question were flighted yet again. And, well, that disclaimer is as small as it ever was.
Perhaps, like losing weight, these things take time.
When it comes to the disclaimer which the ASA's Code requires to be included in all non-medical diet products, my favourite piece of consumer advice is especially relevant - the smaller the print, the more important it is for you to read and heed it.
To quote directly from the Code's Appendix E on slimming. "Claims that mass loss or control, whether permanent or temporary, can be achieved by the use of impulse machines, massages or by any kind of cream or diet aids such as tablets, capsules or liquids may only be advertised as being effective when linked to an approved kilojoule restricted diet.
"Due prominence should be given, therefore, in all advertisements to the part played by the diet."
Clearly, the diet product industry relies on people choosing to ignore the inconvenient truth about weight loss.
